In consideration of being allowed to be involved in or participate in any theatrical or artistic display, production, promotion or program (Program) conducted, sponsored or facilitated by the City of Selma Arts Center including, without limitation, being filed, photographed or recorded in connection with the Program I the undersigned acknowledge and agree to the following: 1. I KNOWINGLY AND FREELY ASSUME ALL RISKS OF INJURY TO MY PERSON OR PROPERTY, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE OFFICERS OR EMPLOYEES OF THE CITY OF SELMA AND SELMA ARTS CENTER (THE “CITY”), or others, and assume full responsibility for any such injury arising from my involvement or participation in the Program. 2. I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself immediately from participation and bring the situation to the attention of the appropriate official, immediately. 3. I, for myself and on behalf of my heirs, assigns personal representatives and next of kin, HEREBY AGREE TO AND DO RELEASE, INDEMNIFY, AND HOLD HARMLESS the City, it’s officers, officials, agents and/or employees, other participants, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Program (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH, OR PROPERTY DAMAGE that I may suffer, or incur, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. Health Statement I will notify the City, Owner of the property at which the Program is to occur or employees of City, if I suffer from any medical or health condition that may cause injury to myself, others, or may require emergency care during my participation. Media/Photo Statement By signing below, I hereby grant and convey to City, or Property Owner of the property where the Program occurs, all rights, title and interest in and to record my name, image, voice, or statements including any and all photographic images and video or audio recordings made by the City, or by others making such recordings of the Program. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Assumption of the Risk and Waiver of Liability Relating to Covid-19 I agree that the City of Selma, its officers and employees and agents shall not be liable for any exposure to or infection with Coronavirus and/or COVID 19, or any other contagious or infectious disease arising out of my child’s participation in in the above program and that I will defend and indemnity the City of Selma, its officers, employees or agents from and against any loss, liability , charges and expenses (including attorneys fees) arising out of my child’s exposure to or contraction of any disease arising from participation in the above program. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself including but not limited to, personal injury, disability, illness, damage, loss, claim, liability, death or expense of any kind that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the above program. On my behalf and on the behalf of my child(ren)’s, I hereby release, covenant not to sue, discharge, and hold harmless the City of Selma’s employees, agents, and representatives, of and from any claims, including liabilities, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the City of Selma, it’s employees, agents, and representatives, whether Coronavirus and/or COVID-19, or any other infectious disease occurs before, during or after participation in any of the City of Selma’s Community services program or by participating in activities held on the City of Selma’s property.
